RNC defends statement on Kagan using Thurgood Marshall amid controversy

By Michael O'Brien - 05/10/10 03:43 PM ET

The Republican National Committee (RNC) defended a statement from its chairman Monday, which Democrats said had the effect of defending slavery.

The RNC's communications director, Doug Heye, took to the committee's blog to defend a statement from RNC Chairman Michael Steele this morning, in which Steele criticized Elena Kagan for having referenced remarks by former Supreme Court Justice Thurgood Marshall, who had called the Constitution "defective" for permitting slavery.

The WH released this photo today of the late Supreme Court Justice Thurgood Marshall and his young clerk - Elena Kagan. Link

I certainly hope she references SCOTUS Justice Thurgood Marshall saying that the Constitution was 'defective' for permitting slavery. That makes me like her a lot more!

The Constitution was most certainly defective in not permitting women to vote. It was defective in that there were no founding mothers among the writers and women's interests were not considered.   BTW, I have trouble with the fundamentalism of extreme conservatives esp Tea Partiers who want to revert to what the founders wrote for these very reasons.

Justice Thurgood Marshall is perhaps the best judge we have ever had on that SCOTUS. I am just delighted that Elena Kagan is his protege.  Well, if I had any question about her, no more questions. I like her already.

I totally agree about the deficits in the constitution for the reasons you cite, Sanders.

The Republicans really, really need to develop some kind of consistent, reasonable strategy in advancing their party and in responding to those outside their party. They also need to try to mitigate the damage that the far right does very frequently. The Pubs are in a position that was not foreseeable just a few months ago - with their chances for taking back the wh having improved significantly, and their chances for greatly increasing their numbers in house and senate being excellent.

If they want to blow it, they can continue making some of the careless mistakes they tend to make.

I appreciate the comment by Kagan, as well. There may be others factors related to her to criticize, but IMO, that statement was not one of them.
