"A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

"If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

"In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

"In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent plaintiffs Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, also were restored to the case.

"But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

"The judge did comment that if there are legitimate constitutional questions regarding Obama's eligibility, they need to be addressed and resolved.

"Carter ordered a hearing Oct. 5 on the motion to dismiss and ordered arguments submitted on the issue of discovery.

"If the case survives that challenge, a pretrial hearing has been scheduled for Jan. 11 and the trial for two weeks later.

"The case would be the first time, according to Kreep, that the actual merits of the dispute will have been heard in open court. A multitude of such disputes have been rejected out of hand by various state and federal courts. Even the U.S. Supreme Court repeatedly has rejected urgent appeals to hear the evidence.

"The suit alleges Obama is actually a citizen of Indonesia and "possibly still citizen of Kenya, usurping the position of the president of the United States of America and the commander-in-chief."

Alex, Happy birthday.... I hope this brave judge has amble protection.. I don't trust any of that illegible fraud's thugs...

I think this Judge is a former Marine, right? God bless him for sticking up for the US constitution and for sticking up for America and the rule of law!!

Thanks, ya'll!  I worded that badly, and have tried to fix the title.  The judge will decide, if I understand this correctly, on October 5th whether or not to ask for BO's documents, and whether or not to consider the Department of Justice's request to dismiss the case.  Then, on January 11th, there will be a pretrial hearing.  That there's my birthday.smile

I consider this a HUGE vindication for us Birthers/Constitutionals.  If there was nothing to this, Judge Carter would not have continued this case.  Thank God he did!!  And thanks to all who have supported this cause - all we're asking is for the Constitution to be followed - three simple requirements.

Yes, and here is where ALL that money has got him - this is what Judge Carter said today:

Judge Carter: “If President Obama fits the qualifications under the rules of the court, the longer the delay the more credibility it lends to the complaint,” he said. “If President Obama does not meet the court’s requirements, the delay also causes a problem.”

O-ineligible might be better off using that money to move to an undisclosed location.

Justice moves slowly. Let's hope it continues to move to reveal the fact that BHO is in violation of the Constitution as he is not a natural born citizen. Our laws do matter.

Thanks again for the good wishes!  I have been soooo happy - every time I think about it, I get a HUGE grin on my face!

We worked very hard to get this outcome.  It's definitely a vindication for Birthers/Constitutionalists.  We're not there yet, but we've got a BIG green light!

That's a very good point, endodoc.  Some Birthers are upset because the judge did not immediately demand Obama's paperwork, dismiss the Department of Justice's request to forget the whole thing, and take it immediately to trial.  I'm not a legal eagle, but I do know that sometimes it takes a little while to make things happen, judicially.

My husband attended the Sept. 8th hearing and said that the Honorable David Carter was the most fair judge he (or anyone else) had witness.
In this hearing, it was centered on the three attorneys involved in the Orly Taitz case.  A lot of discussion in the court and in the chambers to how to proceed when each of these attorneys had a difference in their approach on how to try the case.  The judge insisted that they get along and took a great amount of time for them to come to a resolve.  When they couldn't get along, the judge said that they are all remaining on the case and that the court is willing to hear the different approaches.  Meanwhile, oblabla's side consisted of two Los Angeles attorneys and one from Wash.DC.  When the judge started to 'book' court time for future discoveries and trial dates, his attorneys were visibly upset. (I think they are going to try and get David Carter removed from the case).
The reason the judge would not look at the document that Lucas had on him (even after Orly had said that Lucas's life is being threaten) is because the other side said that they were not given enough time to depose and examine the evidence (they are dragging this out, of course).  The judge said to Orly, "if the situation was reversed, I don't think you would be agreeing to me looking at their evidence without first allowing you to look at it".  And, Orly agreed with the judge.
Yes, the wheels of justice move slowly, but they continue to move. It's good news.
